Brattle Principal Dan Harris will join a Clifford Chance seminar, “Winter is Coming (Again) – Mitigating the Risk of ‘Efficient Breach’ in Gas Supply Agreements,” to discuss navigating the economic and legal effects of another liquefied natural gas (LNG) spot price spike on Wednesday, June 30 from 9:00–10:00 a.m. (BST).

In late January 2021, a sudden confluence of winter demand, shipping constraints, and supply side factors caused the spot Asian LNG prices to spike to record highs. Consequently, debates arose about whether sellers could elect to breach an earlier sales agreement and sell for a windfall on the spot market. At the seminar, panelists will discuss the underlying drivers for last winter’s Asian spot spike, whether we could see price spikes again next winter, the economic and legal mechanisms that exist to ensure spot cargo delivery in the face of price spikes, and more.
