Brattle worked with the ACLU Foundation of Southern California, the ACLU Foundation of Northern California, and their outside counsel at Latham & Watkins LLP in their bid to secure a preliminary injunction that would prevent two Department of Defense (DOD) policies affecting the conditions under which lawful permanent residents (LPRs) could enlist in the military.

These DOD policies would have increased the scrutiny and waiting time for LPRs before they could join the military, and increased the time that the LPRs would have to serve before they would be eligible to become naturalized citizens.

Brattle expert Mark Berkman filed a declaration describing what the economic impact on LPRs and the military would be if the policy changes took effect. Brattle’s work helped result in a preliminary injunction, effectively reversing the policy changes.
