Brattle will host a panel of experts to discuss the legal risks and economic analysis that can be used in data breach and misuse of personal information claims, drawing on experience from matters in both the UK and US. The panel will cover the use of both group and representative actions in the UK, the emerging case law, trends across Europe, and recent judgments such as Lloyd v. Google. In addition, the panel will consider claimants’ theories of harm, the arguments that defendants’ economists will likely make in response, and the approaches economists can take to measure harm in these cases.
