The Brattle Group has once again been named among the top 10 firms for international arbitration experts by Global Arbitration Review in its “GAR 100: Expert Witness Firms’ Power Index.” For the second year in a row, Brattle had the highest average value of claims of all ranked firms, which, at more than $1 billion, is significantly higher than any other ranked firms.

The annual Expert Witness Firms’ Power Index rankings are determined based on several factors from a two-year research period, including the number of hearings each firm participated in, the average value of a firm’s hearings, and reputational clout. During the research period for the 2022 rankings, spanning from August 2020 to August 2022, Brattle worked on 41 unique hearings and 66 disaggregated hearings (where more than one Brattle expert participated in the same hearing). Fifty of the disaggregated hearings were energy-related, the most of all firms included on the index. Brattle also ranked first among all firms for the number of investor-state cases worked on (41).

Who’s Who Legal has recognized two Brattle principals and one Brattle academic advisor in its 2023 guide for Mining Experts.

Principal Dr. Florin Dorobantu specializes in valuation and structured finance issues with a focus on international arbitration. He has testified on damages in cases before the International Centre for the Settlement of Investment Disputes (ICSID), the International Chamber of Commerce (ICC), and the Permanent Court of Arbitration (PCA).

Principal Paul Hinton provides expert testimony and summary witness testimony in securities and finance litigation, enforcement matters involving trading abuse, and in cases involving alleged white collar crime. He regularly employs data analytics and network analysis in white collar investigations to trace funds and to assess allegedly collusive communications.

Academic Advisor Dr. Graham Davis, who is Professor Emeritus in the Division of Economics and Business at the Colorado School of Mines, consults in mine and project valuation for several large mining companies and has significant experience as an expert witness in litigation involving mine valuations and damages from temporary takings.

With both mining and oil and gas projects heavily supported by foreign investments, extraction of natural resources is a highly globalized business. This, coupled with the involvement of governments and state-owned companies in many of these large projects, means that these industries are frequently subject to international disputes – both investor-state and commercial – that often involve significant damages claims.

In a recent chapter included in the fifth edition of Global Arbitration Review’s Damages in International Arbitrations Guide, Brattle Principals Darrell Chodorow and Dr. Florin Dorobantu and Associate Dr. Fernando Bañez discuss the landscape for disputes across extraction project life cycles, from prospecting to closure. They present industry-specific characteristics common to many mining and oil and gas disputes, and examine different valuation methods that may be applied to assess project value or damages across a variety of different commodities and project stages.

The Biden Administration recently opened a trade dispute against Mexico, arguing that it is violating the US-Mexico-Canada Agreement (USMCA) with its efforts to block foreign investments in its fossil fuel and electric power sectors. In a recent Houston Public Media article, Principal Veronica Irastorza was quoted, commenting on how President Andrés Manuel López Obrado’s efforts to limit imports of natural gas could severely impact US companies given that Mexico imports nearly three-quarters of the natural gas it consumes, and 90% of that comes from Texas.

The Brattle Group has welcomed economist Marco Percoco to the firm as an Academic Advisor. An Associate Professor of Applied Economics at Bocconi University in Milan, Dr. Percoco will work closely with the firm’s Antitrust & Competition and Infrastructure practices.

“Marco is a leading authority on the economics of infrastructure, transportation, regulation, and competition,” said Brattle Principal Francesco Lo Passo. “His academic expertise and experience as an advisor will make him a valuable asset to Brattle and our clients, in Europe and globally.”

An expert in transport and infrastructure economics as well as regulatory disputes, Dr. Percoco holds several academic appointments and is the founding director of Bocconi’s GREEN research center, which focuses on economic research related to geography, resources, the environment, energy, and networks. He is a former economic advisor to the office of the Italian Prime Minister as well as to several Italian ministries, the United Nations, the World Health Organization, the Organisation for Economic Cooperation and Development (OECD), the World Bank, the Inter-American Development Bank (IADB), and the European Investment Bank (EIB).

Dr. Percoco’s consulting experience includes working on various regulatory and competition matters across Europe, particularly in the energy, transport, infrastructure, and real estate sectors. He has provided expert opinions regarding concessions, regulation, and antitrust issues in both civil and administrative tribunals. He frequently consults on matters related to infrastructure valuation and regulation.
