Product labels are important tools for consumer protection, and those found on many everyday products – such as food, medications, and household goods – are standardized and governed by regulatory bodies. However, one major product used daily by most Americans is missing standardized labels: broadband internet.

In a recent article for Law360, Senior Consultant Paroma Sanyal and Principal Coleman Bazelon discuss whether the lack of a uniform label – one that includes information on price, performance, and more – for broadband service packages makes it difficult for consumers to make informed decisions about broadband products. They explore the pros and cons of using consumer broadband labels and detail their history, including the Federal Communication Commission’s (FCC’s) 2022 notice of proposed rulemaking that seeks to have broadband internet service providers display detailed labels.

Brattle Principal Dr. Coleman Bazelon was featured in a recent Brookings Institution blog post, “Hard landing: Why the 5G rollout was so contentious and what we can learn from it.” The post noted that, though the Federal Communication Commission’s (FCC’s) C-band auction and the 5G wireless broadband service it enabled was successful, the 5G rollout was blemished by the Federal Aviation Administration’s (FAA’s) delayed concerns about the possible flight interferences caused by 5G signals – concerns that, early on, should have been addressed by the Trump administration. Dr. Bazelon weighed in on lessons learned from the debacle.

A matter Brattle was involved in, William Morris Endeavor Entertainment v. Writers Guild of America, West, et al., has been nominated for the Global Competition Review (GCR) 2022 Awards in the Litigation of the year – Non-cartel defence section, which honors “creative, strategic, and innovative litigation on behalf of a defendant in a non-cartel private action.”

A February 2021 settlement marked the final step in a long-running series of disputes between screenwriters with the Writers Guild of America (WGA) and a number of large talent agencies, including William Morris, Creative Artists, and United Talent Agency. A Brattle team supported the WGA throughout the litigation process, including testimony provided by Principals Coleman Bazelon and James Reitzes that focused on the relationship between showrunners and other writers in the execution of show writing responsibilities and the adverse incentives created by agency ownership of production studios. Brattle’s analyses contributed to a highly successful outcome for the WGA, as the court dismissed William Morris’s preliminary injunction motion and a favorable settlement was agreed upon.
